Jesus Maria Alvarez, also known as El Rancho Feed Store, appealed against Lyssy Eckel, Inc. The appeal was filed in the 218th Judicial District Court of Wilson County, Texas, presided over by Judge Stella Saxon. On June 11, 2003, the appellate court ordered Alvarez to demonstrate cause for not dismissing the appeal due to a failure to file a brief, as mandated by Texas Rule of Appellate Procedure 38.8(a).
