The Texas Court of Appeals, Third District, dismissed the appeal of Sergio Pasquale Maggi, M.D. and his practice, Austin Plastic Surgery Center, against Steven McMillon and others. The appellants failed to file their brief by the deadline of December 22, 2008, and did not respond to a notification from the court on January 21, 2009, regarding the overdue brief. The court warned that a failure to file a motion for an extension of time by February 2, 2009, would lead to dismissal. With no brief or extension motion filed, the court dismissed the appeal for want of prosecution. The decision was issued by Justice Diane M. Henson with participation from Chief Justice Jones and Justice Puryear, filed on March 5, 2009.
