On December 4, 2006, the Texas Court of Appeals notified Shane Supulver that his appeal brief was overdue and warned that failure to respond by December 14, 2006, would result in dismissal for want of prosecution. Supulver subsequently informed the Court of his decision to discontinue his appeal. As a result, the Court dismissed the appeal for want of prosecution under Texas Rule of Appellate Procedure 42.3(b). The dismissal was filed on May 8, 2007, with Justice Jan P. Patterson presiding along with Justices Pemberton and Waldrop.
