Appellant Richard D. Parker and appellees The State of Texas, The City of Houston, and Transit Authority of Houston jointly moved to dismiss the appeal in case No. 03-00-0281-CV. The Texas Court of Appeals, Third District, granted the motion and dismissed the appeal under Texas Rule of Appellate Procedure 42.1(a)(2). The court also dismissed the appellees' motion for rehearing. The judgment and opinion of the court dated December 7, 2000, have been withdrawn, but the opinion itself remains intact. The case was presided over by Judge Peter M. Lowry in the 353rd Judicial District of Travis County. The dismissal was filed on January 11, 2001, and the panel included Justices Kidd, Yeakel, and Jones.
