Dennis Kyle Thurmon, the appellant, is involved in an appeal against several appellees, including Skyline Mobile Home Estates, the United States of America, and various local governmental entities, originating from the 348th District Court of Tarrant County. On February 17, 2009, the court notified the appellant that he had failed to file his brief as mandated by Texas Rule of Appellate Procedure 38.6(a). The court indicated that the appeal could be dismissed for want of prosecution unless a motion explaining the failure and requesting an extension was filed within ten days. No response was received from the appellant. Consequently, the court dismissed the appeal due to the lack of a filed brief, in accordance with Texas Rules of Appellate Procedure 38.8(a) and 42.3(b). The motion to dismiss the appeal filed by Skyline Mobile Home Estates on March 11, 2009, was deemed moot. The appellant is ordered to pay all costs associated with the appeal. The decision was delivered by a panel consisting of Justices Meier, Cayce, and Livingston on March 19, 2009.
