Wendell Wilkins and/or All Other Occupants v. Residential Funding Company LLC F/K/A Residential Funding Corporation
Citation: Not availableDocket: 02-07-00338-CV
Court: Court of Appeals of Texas; November 14, 2007; Texas; State Appellate Court
Wendell Wilkins, along with all other occupants, appealed against Residential Funding Company LLC, formerly known as Residential Funding Corporation. The Court of Appeals for the Second District of Texas dismissed the appeal due to Wilkins' failure to pay the required $175 filing fee, despite being notified on October 3 and October 24, 2007, in accordance with Texas Rule of Appellate Procedure 42.3(c). The court confirmed that the appellant did not meet the procedural requirements outlined by the appellate rules and a prior order from the Texas Supreme Court regarding fees. Consequently, the court ordered the dismissal of the appeal and mandated that the appellant pay all associated costs, with execution for costs to issue. The ruling was delivered by a panel consisting of Justices Holman, Gardner, and Walker on November 15, 2007.
