Scott Ray Kenyon appealed the dismissal order from the 342nd District Court of Tarrant County, which occurred on November 29, 2005. Following this, Kenyon filed a motion for a new trial, which was granted on February 9, 2006, within the trial court’s plenary jurisdiction period. The Court of Appeals for the Second District of Texas notified the parties that the granting of the new trial likely rendered the appeal moot. Upon consultation, Kenyon agreed that the appeal should indeed be dismissed as moot. Consequently, the court dismissed the appeal on its own motion. The case involved the GEO Group, Incorporated, along with Edison Sanchez and Erica Walden as appellees.
