Victor Morales v. State
Citation: Not availableDocket: 01-03-00455-CR
Court: Court of Appeals of Texas; July 15, 2004; Texas; State Appellate Court
Original Court Document: View Document
Victor Morales was convicted of indecency with a child by a jury, which sentenced him to five years of confinement. His court-appointed attorney submitted an Anders brief, declaring the appeal to be wholly frivolous and lacking merit. The brief fulfilled the requirements established in Anders v. California by providing a professional assessment of the record and reasoning why no arguable errors exist. The attorney informed Morales of his right to review the appellate record and file a pro se brief, but over 30 days elapsed without any submission from Morales. After reviewing the record and the brief, the court found no reversible error and concurred with the conclusion that the appeal was entirely frivolous. Consequently, the judgment of the trial court was affirmed. The opinion was issued by a panel consisting of Justices Nuchia, Alcala, and Higley, and it is designated for non-publication.
