The Third District Court of Appeal of Florida issued an opinion on July 23, 2014, concerning the appeal of Jarius A. McTaggart against the State of Florida. This appeal was filed under Florida Rule of Appellate Procedure 9.141(b)(2) from the Circuit Court for Miami-Dade County, presided over by Judge Thomas Rebull. The court, comprised of Chief Judge Shepherd and Judges Lagoa and Fernandez, granted McTaggart's motion for rehearing and/or clarification regarding Case No. 14-898. The court withdrew its previous opinion from May 28, 2014, consolidated this case with Case No. 14-944, and ultimately affirmed the lower court's decision.
