In Re Failure to Satisfy Costs in Lawyer Disciplinary Cases of Boyd
Citations: 969 N.E.2d 592; 2012 Ind. LEXIS 376; 2012 WL 2398266Docket: 94S00-1203-MS-149
Court: Indiana Supreme Court; May 25, 2012; Indiana; State Supreme Court
On March 8, 2012, the Indiana Supreme Court Disciplinary Commission filed a petition seeking the suspension of several attorneys for their failure to pay costs associated with disciplinary actions by the specified deadline. The affected attorneys were identified as Lindsay T. Boyd, Louis W. Denney, Bradley D. Hamilton, Deborah D. Julian (Kubley), Neil C. Thomas, and Gregory A. Watkins. The petition asserted that the respondents violated Indiana Admission and Discipline Rules 23(10)(f)(5) or 23(16) by not paying the costs by the due date tied to their annual registration fee. Subsequently, the Commission moved to dismiss the petition against Boyd, Hamilton, Thomas, and Watkins since they had paid their costs in full. The Indiana Supreme Court granted this motion, dismissing the petition regarding these four attorneys. However, it ordered the suspension of Louis W. Denney and Deborah D. Julian (Kubley) from the practice of law in Indiana, effective ten days from the date of the order. The suspended attorneys are required to comply with all duties associated with their status under Admission and Discipline Rule 23(26). They may apply for reinstatement under Admission and Discipline Rule 2(h), provided they meet the necessary requirements. The Court also instructed the Clerk to distribute copies of the order to the relevant parties and publish it in the Court's decisions. All Justices concurred with the order.
