The United States Court of Appeals for the Fifth Circuit addressed the case of United States of America v. Alfonso Castano, where the government admitted error regarding the denial of Castano's motion to vacate his sentence. The court has withdrawn its previous panel opinion and reversed the order denying the motion. The judgment of conviction and sentence against Castano has been vacated and the case is remanded for the re-entry of judgment, allowing Castano the opportunity to appeal this new judgment. The court refrained from commenting on the legal validity of the government's concession or subsequent actions following any appeal from the new judgment.
