State v. Jimeno
Citations: 564 So. 2d 1083; 1990 WL 107470Docket: 75057
Court: Supreme Court of Florida; July 26, 1990; Florida; State Supreme Court
The Supreme Court of Florida addressed the legality of searching a closed container within a motor vehicle after receiving consent to search the vehicle itself for narcotics. The case stemmed from State v. Jimeno, where the district court of appeal certified the issue as one of great public importance. The Court ruled that, consistent with State v. Wells, consent to search a vehicle does not automatically extend to any closed containers inside it. Consequently, the Court approved the appellate decision, with all justices except one concurring. Justice McDonald dissented.
