The Supreme Court of North Carolina granted the Attorney General's Petition for Discretionary Review in the case of State v. Tony Caudle. The Court vacated the portion of the Court of Appeals’ decision that ordered a remand to the trial court for resentencing. The case was remanded to the Court of Appeals for further reconsideration, specifically in light of the precedent set in State v. Timothy Earl Blackwell. All other aspects of the Court of Appeals’ opinion remain unchanged. Justice Timmons-Goodson recused herself from the case. The order was issued on December 19, 2006.
