The Court of Civil Appeals of Alabama ruled on the case of Morrison's Cafeteria of Montgomery, Inc. v. Inez Haddox, reversing the prior judgment issued on May 26, 1982. The Supreme Court of Alabama had previously annulled this judgment and remanded the case for further proceedings. Consequently, the Appeals Court vacated its earlier decision and reversed the judgment of the Circuit Court of Montgomery County. The case is remanded to the Circuit Court with instructions to grant the defendant's motion for judgment notwithstanding the verdict. Judges Bradley and Holmes concurred with this decision.
