The Court of Appeals of Tennessee affirmed the decision of the Family Court in a divorce case between Rick Allen Williams and Angela Williams. The couple, married on May 23, 1997, and separated on December 4, 2000, had their marital property divided by the Trial Court. Rick Allen Williams appealed, arguing he should receive half of the increase in value of Angela Williams' retirement account and her home during their marriage, as well as the divorce itself. The Trial Court determined that the increase in Angela's 401(k) was marital property but found that Rick did not make substantial contributions to its value increase. The appellate court agreed with this finding, stating the distribution of the 401(k) to Angela was equitable. Regarding the increase in the value of Angela's house, the court found Rick failed to provide sufficient evidence to support his claim for an increase in value, and therefore, could not justify the valuation he proposed. The appellate court upheld the Trial Court's decision and concluded that Rick did not meet his burden of proof on this matter. Angela sought damages for a frivolous appeal, but the court denied her application, noting that Rick's appeal was not taken solely for delay, as he sought an increase in his award. The costs of the appeal were assessed to Rick Allen Williams.
